Also, looking at that painting with the lighting adjusted I'm almost positive the being in it is flying. As of yet we've seen nothing to indicate that Ted can fly. So... hmmm.
In theory The Human Torch and various other comic book characters would need the oxygen as well. If we are going to start dissecting the science of Ted's powers and the fine control he does or doesn't have over them then how could this be any hero at all?

There isn't any evidence that he is flying, and there isn't any evidence that the figure portrayed is consumed by flames perpetually. For all we know about Ted's powers is that they radiate outward from his location. Perhaps that is just phase 1 of Ted exploding and after a split second he's not covered by that red stuff anymore.
No saying if it's fire or not. Perhaps the new hero has the power of turning neon red and turning his hands into flashlights.
So we are going to have two characters that can make stuff hot? Only one doesn't need to breath and isn't radioactive?
Chris Eccleston has been cast from what I've heard, so maybe it is a new character but you can't definitively dismiss Ted, a guy who burns things and causes explosions from being the one depicted in that painting.
We've already seen Isaac's painting of Peter flying. From watching the first episode it's evident that in that particular frame Peter in fact was just falling.
My personal vote is against a character that covers himself in flames and can fly. They could represent him with a symbol like Prince and call him "The Hero that is legally distinct from Johnny Storm."
